CCR Class Action Decertified US District Issues Notice of Termination of the Tolling of the Statute of Limitations

 In late June, 1998, U.S. District Court Judge Charles Wiener approved a revised notice for dissemination to 56 national and international unions to inform them that the Georgine class action had been decertified and the termination of the tolling of the applicable statute of limitations for individual actions had occured. The unions were requested by the Court to notify their active and retired membership as quickly as possible that the suspension of the limitation period for class claims against 20 member companies of the Center for Claims Resolution (CCR) ended as of August 5, 1997. Therefore, any former Georgine class member with a claim for an asbestos-related condition must file that claim in court within the time allowed under state law.

In January 1993, a proposed class action settlement known as Georgine v. Amchem Products, Inc., was filed in the United states District Court in Philadelphia. The class action proposed settlement of personal injury asbestos claims against companies that are members of the Center for Claims Resolution (CCR). The US Supreme Court held that this class action could not go forward, and the class action was decertified (ended) on August 5, 1997.
